Disclaimer

FICP is providing information and services on this site as a benefit and service in furtherance of the association’s non-profit and tax-exempt status. The association makes no representations about the suitability of this information and these services for any purpose. FICP does not exert editorial control over the materials that are posted by third parties onto the site or materials that are e-mailed by third parties to any other persons. FICP is not responsible for any material posted by any third party. FICP specifically disclaims any and all liability for any claims or damages which may result from any postings by third parties.

Limitation of Liability and Indemnity

The great danger for FICP is that we might be held accountable for the wrongful actions of our visitors. If one visitor libels another visitor, the injured visitor might blame us, even though the first visitor was really at fault. If a visitor uploads a program with a computer virus, and other visitors' computers are damaged, we might be blamed even though the virus was left on our board by a visitor. If a visitor transfers illegal credit card information to another visitor through private electronic mail, we might be blamed even though we did nothing more than unknowingly carry the message from one visitor to another.

We did not start this site to take the blame for others' actions, and we cannot afford to operate it if we must take that blame. Accordingly, all visitors must accept responsibility for their own acts, and to accept that an act by another visitor that damages them must not be blamed on us, but on the other visitor. Therefore, as a condition of participation in site, participants must agree as follows:

You agree that FICP will not be responsible to you for any indirect, consequential, special or punitive damages or losses you may incur in connection with visiting this site or any of the data or other materials transmitted through or residing on this site, even if we have been advised of the possibility of such damage or loss. In addition, you agree to defend and indemnify FICP and hold FICP harmless from and against any and all claims, proceedings damages, injuries, liabilities losses, costs and expenses (including reasonable attorneys fees) relating to any acts or omissions by you or materials or information transmitted by you in connection with our forum leading wholly or partially to claims against FICP or this site by other callers or third parties.

User Input

Unless otherwise provided in the Terms and Conditions, any communication, material or feedback with regard to contents on this site transmitted by a user of this site via electronic mail or otherwise, including any data, questions, or comments regarding the content of any document or other information contained on the site, such information shall be deemed to be non-confidential and FICP shall have no obligation of any kind with respect to such information. Unless otherwise agreed, FICP does not claim ownership of the materials you provide to FICP or post, upload, input or submit to the site for review by the general public, or by the members of any public or private community ("Submission"). Unless stated otherwise for specific services, you will retain copyright ownership and all related rights for information you publish through the site. By providing a submission you warrant and represent that you own or otherwise control all of the rights to your submission as described in these Terms including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the submission. By posting the information on this site you hereby grant FICP the right to reproduce, use, disclose and distribute the information to others through this site or in other FICP materials without limitation.

Trademarks

"FICP", the FICP logo, and other FICP logos and titles are registered trademarks of FICP. All other products, company names or other marks appearing on this site are the trademarks of their respective owners. Nothing contained in the site should be construed as granting, by implication, or otherwise, any license or right to use any trademark displayed on the site without prior written permission of FICP or other trademark owners.

Miscellaneous

This document shall be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to any principles of conflicts of law. If any provision of this agreement regarding terms and conditions of use shall be held unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except in writing, signed by authorized representatives of both parties.

Assumption of the Risk and Waiver of Liability Relating to Event Access By Participants

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Governmental restrictions may change at any time without prior notice. As such, FICP (“ASSOCIATION”) cannot guarantee eligibility to travel or to participate in the Event (“the Event”) if restrictions change. Additionally, if Event Attendees choose to attend the Event and enter onto the Event premises, they may be exposing themselves to and/or increasing your risk of contracting or spreading COVID-19.

FICP and its members, officers, officials, directors, instructors, contractors, agents, employees, and any other representative (collectively “Entities”) and the event venue will seek to implement preventative measures to reduce the spread of COVID-19 consistent with the guidance and recommendations of public health agencies for slowing the transmission and exposure to COVID-19 which may include, but not be limited to, health questionnaires for all Event participants, sanitation procedures, and physical distancing measures at the event venue and during the Event.
